Welcome to DeepPrediction Inc (“Company”, “we”, “us”, or “our”). DeepPrediction provides a Software-as-a-Service (SaaS) web application that monitors and acts upon user behaviors in software environments. These Terms of Use (“Terms”) govern your access to and use of our website, web application, and related services (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms.
2. Acceptance of Terms
By accessing, browsing, or using our Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree with these Terms, please do not use our Service.
3. Modifications to Terms
We reserve the right to modify these Terms at any time. When changes are made, we will update the “Effective Date” at the top of this document and notify our users through appropriate channels. Continued use of our Service after such modifications constitutes your acceptance of the revised Terms.
4. Description of Services
DeepPrediction offers a web-based platform designed for business clients (B2B) to monitor user interactions and behaviors within their software applications. Our Service includes:
- Collection of email addresses via our marketing website.
- Registration and account management, where we collect personal details such as name, email, payment information, and additional information provided during sign-up.
- Deployment of our tracking script on third-party websites to capture non-personal usage data (including IP addresses, mouse movements, clicks, scrolling, zooming, viewport size, browser type, and other data contained within the user agent string). Our tracking leverages open source tools (e.g., RRWeb) for session recordings.
5. Data Collection and Privacy
5.1 Data Collection Practices
- Marketing Website: We collect email addresses submitted through our marketing website.
- Application Sign-Up: When you sign up for our Service, we collect personal information including your name, email, payment details, and any other information you provide through our platform.
- Tracking on Third-Party Sites: For websites that integrate our tracking script, we collect various non-personal usage data (e.g., IP address, mouse movements, clicks, scrolling, zooming, viewport dimensions, browser details, and non-personal form inputs) using standard open source technologies such as RRWeb.
5.2 Data Processing and Sharing
- The data we collect is used solely to provide, maintain, and improve our Service. We do not share your data with third parties.
- Some data may be processed using external services (for example, Google Gemini) with the express condition that such data is not used for training external machine learning models.
5.3 Data Security and Retention
- We implement robust security measures, including encryption via Google Cloud, to protect your data during transmission.
- Users of our Service can request data deletion. For customers using our Service on behalf of their own users, it is the responsibility of the customer to communicate deletion requests. We will endeavor to accommodate deletion requests received directly.
5.4 Geographic Scope
- Our Service is intended for use only within the United States. We do not operate in or target users in the European Union, as we are not yet compliant with EU regulations (including the GDPR and AI Act).
6. User Responsibilities and Prohibited Uses
You agree to use the Service only for lawful purposes and in compliance with these Terms. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. Prohibited activities include, but are not limited to:
- Unauthorized access to or interference with our systems.
- Violation of any applicable law or regulation.
- Misusing the data collected through our Service.
7. Intellectual Property
All content, trademarks, and data provided through our Service, including but not limited to software, text, graphics, logos, and other materials, are the property of DeepPrediction or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for its intended purpose.
8. Limitation of Liability and Disclaimers
Our Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law:
- DeepPrediction is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- We do not guarantee the accuracy, completeness, or reliability of any data collected, nor do we warrant that the Service will be uninterrupted or error-free.
- You assume all risk associated with the use of the Service.
9. Termination
We reserve the right to suspend or terminate your access to our Service, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising out of or relating to these Terms or the use of our Service will be resolved exclusively in the appropriate courts located within the United States.
